1.1. The following General Conditions of Sale rule the purchases of products made remotely by the purchaser (hereinafter referred to as "Customer") at Eumedica s.r.l. located in Via della Meccanica, 8/10 - 35127 Padova (PD) Italy (hereafter "Eumedica"), through the website www.eumedica.it (hereinafter the "Site").
1.2. The Site is aimed exclusively at consumers, meaning those individuals who intend to purchase the items for purposes not related to their business, commercial, craft or professional activity.
1.3. Eumedica will only accept orders of products to be delivered within the Italian territory, with the exception of the Municipalities of Livigno and Campione d'Italia. It is also excluded delivery to P.O. box or companies that offer domiciliation services.
2 Purchase modalities
2.1 The products offered for sale are those present at the time of ordering in the "buy online" sections of the Site, and are described in the related information sheets. It is understood that the images of the products may not be perfectly representative of their characteristics, but may deviate in terms of color and/or size also depending on the quality of the image on the screen.
2.2 To place an order, the Customer must be of age and register on the Site providing the necessary data, including a telephone number and a valid e-mail address. Once the purchase online form has been completed and sent by the Customer, a confirmation page will open containing a link to the present general conditions and a summary of the ordered items with their characteristics, the price inclusive of taxes and any shipping and delivery costs. An 'Online Order Number' will also be communicated to the Customer, which must be used for any further communication with Eumedica
2.3 To continue with the purchase you will be asked to read and accept the present general conditions, to print a copy of the same or to save them on a durable medium, and to click on the "Confirm payment" button. The order placed will be valid as an offer for the purchase of the selected products, which Eumedica can accept or not at its discretion. The orders placed are binding for the Customer and cannot be canceled after their forwarding.
2.4 In case of acceptance, Eumedica will send an order confirmation to the email address supplied by the Customer. This order confirmation, the content of which must be stored on a durable medium and of which the Customer may also request a hard copy, will contain all the information relating to the contract concluded with the Client pursuant to art. 49 paragraph 1 of the Consumer Code.
2.5 In case Eumedica is not able to accept the order due to unavailability of the ordered products or other reason beyond control of the Eumedica, the Customer will be informed by email, indicating a possible period of availability of the requested items.
3 Prices and paying methods
3.1 The product prices published on the Site are to be considered in force at the time of order and already inclusive of VAT, but not inclusive of shipping/delivery costs, which are charged to the customer; these additional costs will be specified during the purchase procedure as described above. Eumedica reserves the right to change prices at any time, without notice. In this case, any price change will be applied from the date of publication on the Site and will not affect orders placed before that date.
3.2 The payment of products purchased through the Site and any shipping/delivery costs must be made by credit card or PayPal and will be debited at the time of order confirmation. The Customer's credit card information will be transferred via secure connection directly to the bank that handles the transaction. This information, with the exception of data strictly necessary for the confirmation of payment, will not be used directly or stored in any computer file by Eumedica. In no case Eumedica shall be held responsible for any fraudulent and improper use of credit cards by third parties upon payment of products purchased on the Website.
3.3 Eumedica reserves the right to ask the Customer for additional information (eg landline number) or to ask for copies of documents proving the ownership of the credit card used. In the absence of the required documentation, Eumedica will have the right not to process the order. If for any reason it is not possible to charge the due amount, the sales process will be automatically cancelled as well as the sale. In this case, the Customer will be informed via an appropriate email communication.
3.4 For every purchase made on the Site, Eumedica will issue a transport document of the material shipped,which will be included in the package; the invoice will be sent later by email to the order holder.
4 Delivery costs and methods
4.1 In the case of orders for a unit value of more than 60.00 (sixty / 00) Euros, the shipping and delivery costs will be borne by Eumedica. In other cases, these costs will be communicated to the Customer during the purchase procedure and before the order is placed, as specified above.
4.2 The products will be delivered at the address specified in the purchase form and in accordance with the shipping option requested by the Customer. The delivery operations will require approximately three to five working days, starting from the receipt of the order confirmation email and after the payment of the ordered items. In any case, the delivery of the products will take place at latest within the maximum term of thirty days from the date of conclusion of the contract in accordance with Article 61 of the Consumer Code.
4.3 At the time of delivery of the goods by the courier, the customer is required to check that the number of packages delivered corresponds to what is indicated in the transport documents and that the packaging is intact, not damaged or altered. Any damage to the packaging and/or to the products or the mismatch of the number of packages, must be immediately contested by reporting the reason for the complaint on the delivery receipt that the courier will require to sign.
4.4 In the event that the Customer does not withdraw within 5 (five) working days the goods ordered and stored at the courier's warehouse, due to the repeated impossibility of delivery to the address indicated at the time of order, the products will be returned to the Eumedica and the transport costs for their return will be charged.
5.1 All products sold on the Site are covered by the legal guarantee of 24 (twenty four) months for conformity defects in accordance with the Consumer Code (Legislative Decree No. 206 of 06.09.2005), starting from the delivery date. To take advantage of the warranty, the customer must keep and show the transport document and/or the purchase invoice, which certifies the date of delivery or purchase and the description of the product.
5.2 In the event of a product defect, the warranty entitles the restoration without charge of the product and entails its repair or replacement by Eumedica (unless due to the nature of the defect one of the remedies is impossible or excessively burdensome compared to the other), or if necessary to reduce the price or terminate the contract in the cases provided for by law
5.3 The warranty applies as long as the product has been used correctly, respecting its intended use and as provided in the relevant technical sheet on the Site and/or in the package of the item. The guarantee does not apply, as for a non-exhaustive example, in relation to products or parts of the product subject to usury and/or consumables, or in presence of circumstance that exclude a manufacturing defect of the product itself (eg damage due to fire or water, e.g. for products not expressly declared impermeable).
5.4 If, following an intervention by Eumedica, the fault does not present a lack of conformity under the Consumer Code, the Customer will be charged for any costs of verification and restoration, as well as transport costs for the return of the goods if incurred.
5.5 Without prejudice to the legal guarantee referred to in the preceding points, Eumedica reserves the right to propose to the customer, as a conventional guarantee valid for 24 (twenty-four) months from the delivery date, the replacement of the defective item with another product of equal or superior characteristics and value.
6 Right of withdrawal
6.1 The Customer has the right to withdraw from the contract, without stating the reasons, within 14 (fourteen) days from the date of delivery of the purchased products. To exercise this right, the Customer must send to Eumedica, before the expiry of the withdrawal period, an explicit communication to this effect by registered letter with acknowledgment of receipt addressed to Eumedica srl, Via della Meccanica, 8/10 - 35127 Padova (PD) Italy, or by telegram or fax (to 0498932651) always sent within the aforementioned term of 14 days and followed by a confirmation by registered letter with acknowledgment of receipt, to be sent strictly within the next working day.
6.2 Once the notice of withdrawal has been received, Eumedica will send the instructions on how to return it to the e-mail address indicated by the Customer during the purchase procedure, and in particular the indication of the courier who will collect the product. The costs for returning the goods will be communicated to the Customer and will be charged to the customer. The products must be returned intact and functioning, complete with all their parts and in original packaging (envelopes and packaging). The Customer will be required to respond to the decrease in value of the items being returned resulting from a handling other than that necessary to establish the nature, characteristics and functioning.
6.3 Eumedica will refund the payments received from the customer, including any delivery costs, within 14 (fourteen) days from the date on which it became aware of the right of withdrawal. For purchases made through a PayPal account the refund will be made by crediting the customer's account.
7 Contents and conditions of use
7.1 All contents on the Site must be intended to be strictly informative. The contents and the product data sheets (texts, images, attachments etc.) are aimed exclusively at increasing information to potential customers. The information provided is purely indicative and does not replace the opinion of a doctor or of a professional with specialized knowledge, which can be applied to the specificity of each individual case. Eumedica does not provide prescriptions or medical opinions and will not be liable for damages resulting from improper use of the information on the Site.
7.2 The Customer or the visitor will use the Website and proceed to the purchases under their own exclusive responsibility, accepting and acknowledging not relying on the information contained therein in order to make decisions regarding their state of health and/or any remedies.
7.3 Before using any product, carefully read the instructions provided, paying particular attention to the contraindications and warnings if any. If the contraindication page contains no contraindications, anyone can request it through the appropriate "Contacts" link on the site or by telephone.
8.1 Eumedica collects personal data provided specifically and voluntarily by the user of the Site. Personal data means information that can identify a specific person such as the name, address, telephone number and/or email address. These personal data are requested during registration on the Site and are collected and processed in order to allow the user to proceed with the online purchase of products. In this case the personal data will also be processed to allow the completion of the transaction and the management and execution of the same, starting from the purchase proposal and until the delivery of the products. In this context, and with particular reference to the phase of delivery and/or eventual withdrawal of products, the processing and use of the data will also concern their communication to the subjects of which Eumedica makes use of for the execution of these activities, which however they cannot in turn use them for different purposes or purposes.
8.2 Eumedica guarantees the customers with the respect of the law on processing of personal data, governed by the code on protection of personal data (so-called Privacy Code) pursuant to Legislative Decree no. n. 196 of 30.06.03. The data controller is Eumedica s.r.l. in the person of the legal representative,Via della Meccanica, 8/10 - 35127 Padova (PD) Italy.
8.3 The user is entitled at any time to obtain confirmation of the existence of above data, to know the content, verify its accuracy or request its integration or updating or correction (Article 7 of the Privacy Code) ). Pursuant to the same article, the user may revoke consent to the processing of personal data with written notice to be sent to the registered office of Eumedica.
8.4 Any marketing communications will be sent only with the explicit consent of the user, received together with the authorization to process the data and to send it to the registration form.

9 Jurisdiction and law applicable
9.1 The contract of sale between the Customer and Eumedica is concluded in Italy and governed by Italian law. For any disputes the territorial jurisdiction is that of the Court of reference of the Municipality of residence of the Customer.
10 Adjustments and revisions
10.1 The conditions contained in this document may be modified by Eumedica without prior notice and will be valid from the date of publication on the www.eumedica.it website.
